Unit Registration & Purchase
There are four parties involved in buying and selling buildings and units in Discovery Gardens. It is crucial to identify and distinguish between these parties, and clearly understand their individual roles.
Discovery Gardens LLC, a wholly owned subsidiary of Nakheel PJSC: is the Master Developer that builds and registers properties in Discovery Gardens. The developer sells entire buildings and not units. Building Owners purchase entire buildings and all the units inside them from the developer. They can then sell these units to Unit Buyers.
Building Owners: Building Owners are those who purchase entire buildings and all the units inside them from the developer. Building Owners are allowed by the developer to sell units in their buildings to Unit Buyers. When Building Owners sell these units, they are required to request Nakheel to prepare the unit contract for signing by the Building Owner and the Unit Buyer.
Sales Agent: Building Owners usually appoint Sales Agents to market, sell and manage their buildings. Sales Agents' statements do not hold legal weight, unless backed by the developer’s contracts. Nakheel or the developer does not appoint these sales agents and cannot be responsible for any statements or promises made by them.
Unit Buyer: A Unit Buyer purchases one or more apartments from the Building Owner. Unit Buyers do not deal directly with Nakheel or the developer and should contact the rightful Building Owners to buy apartments from, and simultaneously ensure that their purchase is recorded at Nakheel through the Building Owner.
Note: For any facts relating to your unit including payment structure, handover date, square footage, etc always refer to the unit contract issued by Nakheel. Any unit purchasers that are not recorded with Nakheel cannot be recognized by Nakheel. 1) Will Nakheel give guarantees for Building Owners' promises and actions?
Due diligence must be exercised until a unit contract is issued by Nakheel. You can and should approach Nakheel for a confirmation that a certain Building Owner that you are considering to buy from has proper credentials and a recognized contract with Nakheel. Immediately after that, you must ask for your Unit Contract for the unit/apartment you are purchasing to safeguard your interests.
2) What is a Unit Contract?
A Unit Contract is entered into between the Building Owner and the Unit Buyer, agreeing on the terms and conditions of sale. Nakheel is not a party to this agreement. The Unit Contract is the only document that will provide you with legal protection in the event of a dispute or handover. Booking orders and reservation papers, etc. are not recognized and cannot be enforced.
3) When do I get my Unit Contract?
The Building Owner is legally obliged to give unit buyers their Nakheel-issued Unit Contracts before the transaction is complete. If your Building Owner is withholding your contract or not applying for one, please provide Nakheel with details and proof of purchase (a booking order, invoice, etc.) so that the matter can be investigated further.
4) Are all unit buyers eligible for a "freehold title" and/or "residence visa"?
Yes, provided that they comply with any and all guidelines that may be required by regulatory bodies. Nakheel will process the freehold visa and title for unit buyers, provided they meet necessary criteria. Please note that Nakheel issues only one visa per property and that it doesn't entitle the unit owner to work in the UAE.
5) Does the Building Owner or the Unit Buyer pay the registration fees?
Nakheel is not involved in that decision. It depends entirely on the Building Owner's agreement with the Unit Buyer.
6) Has my Building Owner fulfilled all obligations to Nakheel? How can I get my Building Owner's contract details and contact details?
Nakheel's dealings with its Building Owners are covered by a confidentiality agreement, and can not be made public. However, if you have any issues with registration or procuring a Unit Contract from your Building Owner, we will be able to confirm the ownership of the building or assist in any possible way.
7) Can I have the property details and floor plans for my unit?
Unit Buyers should request that Building Owners provide them with details and floor plans for the unit they purchased. Once Nakheel issues a formal Unit Contract to the Unit Buyer, the property details and plans will be included within.
8) When will the Discovery Gardens be completed?
All Mediterranean & Mogul buildings will be completed by July 2008 as anticipated in the contract.
